By using and/or visiting this website (collectively, including all content and functionality available through the newsciencejournalism.net domain name, the "New Science Journalism Website", or "Website"), you signify your agreement to (1) these terms and conditions (the "Terms"), (2) New Science Journalism's Privacy Policy, incorporated here by reference, and (3) New Science Journalism's Project Guidelines, also incorporated here by reference. If you do not agree to any of these Terms, the New Science Journalism Privacy Policy or the Project Guidelines please do not use the New Science Journalism Website.
The New Science Journalism Website is designed to allow individuals or 'multiple authors' (collectively, "Correspondents") a wider distribution of their work, to the benefit of interested readers ("Readers") by making their work available on the internet. Anyone who accesses our sites, whether as an Correspondent or a Reader, is regarded as a "User" and is subject to these Terms. Your use of the New Science Journalism Website constitutes your binding acceptance of these Terms, as we may modify them from time to time by posting revised Terms on our sites.
You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.
Although we may attempt to notify you when major changes are made to these Terms, you should periodically review the most up-to-date version of the Terms. New Science Journalism may, in its sole discretion, modify or revise these Terms and policies at any time, and you agree to be bound by such modifications or revisions. Nothing in this Agreement shall be deemed to confer any third-party rights or benefits.
Please be aware that Individual Correspondents may impose additional terms upon the User accessing their work. By using the New Science Journalism Website, you acknowledge that your use is subject to these additional conditions, which are incorporated into these Terms by reference. All rights that we have reserved with respect to these Terms also apply to any additional terms imposed by any Correspondent.
As part of our right to establish the rules governing the New Science Journalism Website, we may, but are not required, to take any of the following actions if we regard them as necessary. We may do so in our discretion and we are not required to give notice: (1) suspend, terminate or otherwise limit or restrict your access to all or any part of the New Science Journalism Website; (2) change, suspend, or discontinue all or any part of the services we provide; (3) decline to make content available on the New Science Journalism Website or remove content once it is available or (4) deactivate accounts and all related information and files. New Science Journalism reserves the right to discontinue any aspect of the New Science Journalism Website at any time.
By using the New Science Journalism Website, you agree that we will not be liable to you or any third party for taking any of the above actions.
The New Science Journalism Website may contain links to other sites owned by third parties. Your use of each of those sites is subject to the conditions, if any, that each of those sites has posted. We have no control over sites that are not ours, we do not express any opinion with respect to such sites, and we are not responsible for any changes to or content on them. You are responsible for all interaction with third parties, including any commercial transactions. We will not be responsible or liable for any loss or damage of any sort incurred as the result of any of your transactions with third parties.
CONTENT
Correspondents are solely responsible for all content they make available on our sites. Any Correspondent who makes content available, by doing so, certifies that he/she owns all intellectual property rights in the content and grants us a worldwide, irrevocable, royalty-free, nonexclusive, sub-licencable licence to use, reproduce, distribute, publicly display, transfer, transmit, distribute, and publish content for the purposes of (i) displaying content on our sites, (ii) distributing content by any means to users seeking to access it, and/or (iii) storing content. This license shall have the widest possible application. It will apply to the distribution and the storage of content in any current or future medium.
The content on the New Science Journalism Website, except all User Submissions (as defined below), including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to New Science Journalism, subject to copyright and other intellectual property rights under the law. Content on the Website is provided to you AS IS for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. New Science Journalism reserves all rights not expressly granted in and to the Website and the Content.
Content may be offensive or inaccurate. Readers bear all risks associated with using any content. We have the right, but not the obligation, to remove any content that may violate these Terms or that is otherwise objectionable.
An abuse reporting system is operational for all New Science Journalism publications, which provides Readers with a mechanism to highlight offensive material, adult content or copyright infringements. New Science Journalism will consider all alleged reports of abuse but is not obliged in anyway to remove or suspend the publication on the basis of the report alone. The decision to suspend publications is at the sole discretion of New Science Journalism and will be taken in accordance with the New Science Journalism Content Abuse Guidelines
USER SUBMISSIONS
As a New Science Journalism account holder you may submit news content ("Correspondent News") and textual content ("User Comments"). Correspondent News and User Comments are collectively referred to as "User Submissions." You understand that whether or not such User Submissions are published, New Science Journalism does not guarantee any confidentiality with respect to any User Submissions.
You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorise New Science Journalism to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms.
For clarity, you retain all of your ownership rights in your User Submissions. However, by submitting User Submissions to New Science Journalism, you hereby grant New Science Journalism a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the New Science Journalism Website and New Science Journalism's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the New Science Journalism Website (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the New Science Journalism Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, display and perform such User Submissions as permitted through the functionality of the Website and under these Terms. The above licenses granted by you in Correspondent News terminate within a commercially reasonable time after you remove or delete your Correspondent News from the New Science Journalism Website. You understand and agree, however, that New Science Journalism may retain, but not display, distribute, or perform, server copies of User Submissions that have been removed or deleted. The above licenses granted by you in User Comments are perpetual and irrevocable.
In connection with User Submissions, you further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant New Science Journalism all of the license rights granted herein.
You further agree that you will not, in connection with User Submissions, submit material that is contrary to the New Science Journalism Project Guidelines, which may be updated from time to time, or contrary to applicable local, national, and international laws and regulations.
New Science Journalism does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and New Science Journalism expressly disclaims any and all liability in connection with User Submissions. New Science Journalism does not permit copyright infringing activities and infringement of intellectual property rights on its Website, and New Science Journalism will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights. New Science Journalism reserves the right to remove Content and User Submissions without prior notice.
PRIVACY POLICY
All of the information that we collect from you is subject to our Privacy Policy.
ACCOUNT INFORMATION
You will provide us with true, accurate, current, and complete information in response to any request. It is your responsibility to update your information. Do not reveal or share any passwords or account information. Tell us if someone is using your password or account. Failure to do so absolve us of all responsibility we may have.
The technology and the software underlying the New Science Journalism Website is the property of New Science Journalism, its affiliates and licensors. You have no interest in this property. You cannot disclose, use, copy, modify or transfer it in any way without our prior express written permission. Unapproved access to the New Science Journalism Website is a breach of these Terms and a violation of the law. You agree not to access the New Science Journalism Website by any means other than those approved by us. CONDUCT
It is impossible to list all the forms of prohibited conduct. We will fully cooperate with all law-enforcement requests or requirements relating to your use of our sites. We reserve the right to determine what conduct is prohibited. The following are only meant as examples of prohibited conduct:
(1) Violating the legal right of others or otherwise violating the law in any way; this includes illegally downloading files, making false statements including use of false identities and/or affecting use of the sites by others - you are responsible for knowing whether your actions violate this prohibition; (2) Transmitting information that may affect the operation of another person's system, such as files that contain viruses or corrupted files; (3) Advertising (including contests) without our express prior written consent; and/or (4) Interference with our sites, including overloading.
You agree not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Website in a manner that sends more request messages to the New Science Journalism servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, New Science Journalism grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. New Science Journalism reserves the right to revoke these exceptions either generally or in specific cases.
You agree not to collect or harvest any personally identifiable information, including account names, from the Website, nor to use the communication systems provided by the Website (e.g. comments, email) for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the Website with respect to their User Submissions.
In your use of the Website, you will otherwise comply with the terms and conditions of these Terms, New Science Journalism Project Guidelines, and all applicable local, national, and international laws and regulations.

OFFENSIVE AND ADULT GUIDELINES
All content contributed to New Science Journalism must adhere to the laws of the country from where the material is uploaded and must not breach any laws in the United Kingdom, Germany, United States of America and Australia. New Science Journalism does not allow the use of offensive material or adult content and New Science Journalism reserves the right to de-publish any material without notice that does not comply with the Project Guidelines.
WARRANTY DISCLAIMER
You agree that your use of the New Science Journalism Website shall be at your sole risk. To the fullest extent permitted by law, New Science Journalism, its officers, directors, employees, partners, sponsors or agents, disclaim all warranties, express or implied, in connection with the website and your use thereof. New Science Journalism makes no warranties or representations about the accuracy or completeness of this site’s content or the content of any sites linked to this site and assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our website, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from our website, (iv) any bugs, viruses, trojan horses, or the like which may be transmitted to or through our website by any third party, and/or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the New Science Journalism website. INDEMNITY
You hereby agree to indemnify, defend and hold New Science Journalism and all of our shareholders, officers, directors, owners, employees, agents, partners, affiliates, licensors and/or Users (collectively, the "Indemnified Parties") harmless from and against any and all liability, losses, costs, and expenses (including but not limited to attorney's fees) incurred by any Indemnified Party in connection with any claim directly or indirectly arising from: (i) your use of and access to the New Science Journalism Website; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party. We are not responsible for any loss of any type arising from the use of our sites, whether or not arguably within our control. We do not warrant that the New Science Journalism Website will be uninterrupted or error free. In addition, we do not make any warranty as to the content on our sites. DISPUTE RESOLUTION

Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Australia, and judgment on the arbitration award may be entered in any court having jurisdiction thereof. Either you or we may seek any interim or preliminary relief from a court of competent jurisdiction in Australia, necessary to protect the rights or the property of you or New Science Journalism or any New Science Journalism party, pending the completion of arbitration.
MEDIA COPYRIGHT NOTICE
All User Submission content and graphics on the New Science Journalism Website are protected by international copyright treaties and other applicable copyright laws and may not be copied without the express permission of the Correspondent, who reserves all rights. Re-use without the Correspondent's permission is strictly prohibited. We encourage the owners of intellectual property rights who believe their rights are being infringed by a Correspondent who displays content on the New Science Journalism Website to resolve their disputes directly with that Correspondent.
As a courtesy to owners of intellectual property rights, we are willing to perform a limited investigation of reasonable complaints. However, we provide no guarantee that we will remove the allegedly infringing materials from our site.
